SOLE SOURCE ADVANTAGES

SBA may award a direct award contract (sole source) with an unlimited ceiling to an 8(a) participant owned and controlled by a Native American tribe per 13 CFR 124.506(b).
Sole source offers flexibility and reliability through direct negotiations per 13 CFR 124.503 and competitive threshold exemptions per 48 CFR 19.805-1.
Elimination of pre-award schedule risk as Native American sole source procurements cannot be protested per 13 CFR 124.517(a).
Tribal 8(a)s like Red Cedar TG, unlike other 8(a) companies, provide the Government with a virtually unlimited sole source ceiling per 48 CFR 6.303-1.

WHY TRIBAL 8(A)?

The Government may award sole source contracts to Tribal 8(a) companies up to $22M without Justification and Approval (J&A) and more than $22M with J&A, offering an unlimited threshold per 13 CFR 124.506(a).
Small and SDB credit received through subcontracting work to Red Cedar TG (FAR Subpart 19.703).
Indian Incentive Program (IIP) – 5% rebate to prime contractors (DFARS Clause 252.226.700).
Certified as a “Buy Indian” firm under the Buy Indian Act 25 U.S.C.47. Buy Indian regulations are included in the Department of Interior Acquisition Regulations (DIAR) part 1480 and allow bureaus to set aside procurement contracts to firms with this status.
